The procedure and conditions for the issuance of licenses
Licensing of telecommunications carried out in accordance with the laws of the Republic of Uzbekistan for licensing in the field of telecommunications
Licensing of activities of legal entities in the telecommunications sector provides the Uzbek Agency for Communication and Information in accordance with the "Regulation on licensing of activities in the field of telecommunications," approved by the Cabinet of Ministers of 22.11.2000, № 458 "On measures to improve the governance of Posts and Telecommunications. "
The order of issue (refusal), suspension or termination and revocation of licenses is determined by the Cabinet of Ministers of the Republic of Uzbekistan
Admission and registration statements applicants licenses to engage in activities in the field of telecommunications, registration of license agreements and licenses, as well as the organization of meetings of the Expert Commission on licensing department carries out licensing and standardization (Olis) of the Uzbek Agency for Communication and Informatization.
Meeting of the Expert Committee on Licensing is held at least once a month.
In the telecommunications activities subject to licensing the design, construction, operation and service of telecommunications:
- Local networks; - Inter-city networks; - International networks; - Networks of mobile telephone communications; - Personal radio networks; - Data networks; - Networks of distribution (broadcasting) TV and radio programs.
Competitors of licenses may be licensed in several telecommunications networks, depending on the work performed, as well as a number of activities (design, construction, operation and provision of services).
Activities in the field of telecommunications can only be legal entities.
According to the "Regulations on the procedure of competitive allocation of radio frequencies and the granting of individual licenses in the field of broadcasting", approved by the Cabinet of Ministers of the Republic of Uzbekistan dated 20 December 2004 № 592 "On measures to ensure the efficient use of radio spectrum in the field of broadcasting," the issuance of individual licenses for the right to work in dissemination (broadcast) television and radio programs (except for enterprises whose main activity is the creation and distribution (broadcasting) of state television and radio programs, or in the authorized capital of the state share of the property is not less than 50 percent) on a competitive basis.
License for the design, construction, operation and service delivery of local, long distance, international networks, networks, mobile radio communications, paging issued for a period of 5 to 15 years. License for the design, construction, operation and provision of services of data transmission networks, distribution networks, television and radio broadcasts are issued for a period of 5 years.
Documents required to obtain a license
To obtain a license the license applicant to the licensing authority the following documents: a) the application for a license in the prescribed form specifying: - The name and legal form of a legal entity, its location (street address), name of the banking institution or bank account in a banking institution; - A licensed activity (or part thereof) which is a legal entity intends to carry out, and the time within which to perform the specified activity; b) a copy of the certificate of state registration of the legal entity; c) a document confirming the applicant for the license fee in the amount of two times the minimum wage for the examination of the application by the licensing authority; d) a certified copy of the certificate of state registration of mass media in the Uzbek Agency for Press and Information for obtaining a license for the operation and provision of distribution networks (broadcast) television, radio and data transmission; d) list: major telecommunications means (available on the property rights or other legal basis) with their characteristics, ranges and nominal frequencies (if used) - to receive a license to operate, and (or) services of telecommunications networks; hardware (available on the property rights or other legal basis), and legal documents needed to carry out the design, construction - for a license to design and (or) the construction of telecommunications networks; e) The management plan and forecast of the network, other relevant information, depending on the work performed in the prescribed form (the number of subscribers, ports, intercity, international stations, systems and data networks, coverage and other parameters for specific networks or telecommunications facilities); g) documents proving the ability of the applicant for license requirements and conditions imposed to obtain a license for certain activities in the field of telecommunications; duly certified copy of the diploma, employment record specialists in design, construction, telecommunications networks - for a license to design and (or) the construction of telecommunication networks. - The conclusion of the relevant authorities of compliance with sanitary and fire regulations and activities of the facility; - A statement of the use and control of radio frequencies Republic of Uzbekistan on the possibility of the use of frequency assignments capacity data transmission devices (with a license for activities related to the use of radio); - In the case of alleged use of equipment belonging to another person, it is proof of rent (use) of the equipment. Documents may be presented in the form of a contract or a copy thereof, duly certified. When you receive a license to provide services provider of data networks, including the Internet, through a network of data transmission operators, without the right to create its own network, the documents referred to in subparagraphs "d", "e" and "f" of this paragraph shall not be submitted.
When applying for a license to operate on the networks of distribution (broadcast) television and radio broadcasting programs with foreign TV and radio stations from the territory of the Republic of Uzbekistan for third countries require additional documents to meet the conditions of the international agreements
To participate in the competition on the distribution of frequencies in the implementation of on-air broadcasting license applicant shall submit to the Interagency Coordination Commission for the improvement and efficiency of information and data at the Cabinet of Ministers of the Republic of Uzbekistan (ICC) application and the following documents: a) a certified copy of the certificate of state registration of the legal entity; b) certified copies of the founding documents of the legal entity; c) a document confirming the applicant for the license fee for consideration of proposals; d) a document confirming the payment of the deposit by the license applicant; d) documents (diplomas, certificates, certificates), the qualifications of employees directly involved in the process of distribution services on television and radio programs; e) The detailed concept of broadcasting, including creative, technical and financial proposals, as well as the planned TV and radio broadcasting network, the volume of broadcast its own programs and competitive obligations; g) Finally, the relevant authorities of compliance with sanitary facilities broadcasting, fire regulations and measures for the protection of the facility; h) documents confirming the right to use equipment designed for broadcasting organizations, if it belongs to another person (the lease, etc.).
For the submission of false or distorted information the license applicant is liable under the laws of the Republic of Uzbekistan.
Consideration of the application and issuance of the license
For consideration by the licensing body of the application of the license applicant for each activity will be charged a fee of two-time minimum wage established in the Republic of Uzbekistan.
In case of cancellation of the license applicant submitted application, or in the decision by the licensing authority to refuse to issue the license fee amount paid no return.
The decision to grant or refuse to grant a license the licensing authority shall not later than thirty days from the date of receipt of the application of the license applicant with all necessary documents.
The reasons for denial of a license may be: - Presentation of the license applicant improperly executed documents; - Presence in the documents submitted by the license applicant, false or distorted information; - Inconsistency of the license applicant licensing requirements and conditions, as well as the conditions of competition (tender). The refusal to grant a license on other grounds, including on grounds that are not allowed.
In the case of removing the license applicant within the prescribed period the causes that gave rise to the refusal to grant a license, the re-examination of the documents is carried out within a period not exceeding ten days from the date of receipt of the application of the license applicant with all necessary documents. During the re-examination of the statements license applicants fee will be charged. The claim submitted by the date specified in the notice of the refusal to grant a license, it is considered again served.
Issuance of the license is made after the payment by the applicant of the state fee and signing of the license agreement.
The size of the state fee established by the Cabinet of Ministers.
State fee is set at the rate of one-year multiple of the minimum wage, set at the date of payment of the state fee.
The state fee is payable in the amounts that are multiples of the period for which the license is issued.
State fee may be paid in equal annual installments during the term of the license or may be paid a lump sum for the entire term of the license.
If the licensee, within three months from the date of (delivery) of the notification of the decision to issue a license to the licensing authority did not submit a document confirming payment of the state fee for the license, or not signed a license agreement, the licensing authority may revoke the license.
Register of licenses
Information on granted, suspended, renewed, rescheduled, canceled licenses are contained in the register of licenses of the Uzbek Agency for Communication and Informatization.
The information contained in the register, is open to familiarize the interested parties and submitted the written request in the form of an extract from the register. Information provided from the register in respect of a licensee's fee of 50 percent of the minimum wage. The organs of state power and control information is provided free of charge.
