History of Inspection on Control in the Field of Information and Telecommunications of the Republic of Uzbekistan

The State Communication Inspection was established on 16 January 1991 based on the decree of the Cabinet of Ministers No. 13 and 1 February 1991, the order of the Ministry of Communications. The activities of the new organization consisted in controlling the malfunctions, shortcomings, quality indicators in the field of postal and telecommunication, as well as their response to the demand of consumers in accordance with the standards.

After the independence of the Republic:

  • January 13, 1992, "On Communication";
  • May 6, 1993 "On labor protection";
  • September 2, 1993 "On State Statistics";
  • December 28, 1993 "On Metrology" and "On Certification of Products and Services";
  • On May 6, 1994, a number of new laws "On Citizens' Appeals" were adopted.

Thus began a period of promising innovations in the field of communications.

On April 26, 1996, the Law "On Consumer Protection" was adopted. The adoption of the "Regulations on licensing in the field of communications and transport" by the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 175 was another impetus for the development of the industry.

On December 26, 1997, the Republic of Uzbekistan is gradually moving towards a democratic society, adopted the Law "On Mass Media" to ensure freedom of the press, which is the main principle and basis of this society. This process has led to the adoption of a number of legal and regulatory documents on the provision of information to the public that is the approval of procedures for licensing, certification of products and services import of foreign equipment.

All this led to a sharp change in the activity of communication inspection. In this regard, by the decree of the Cabinet of Ministers № 293 of July 10, 1998, a new regulation on the establishment of state control over the activities of postal and telecommunications economic entities in the Republic of Uzbekistan was approved. According to this regulation, it was determined that the Inspection of communication carries out its activities in accordance with the laws of the Republic of Uzbekistan, the decisions of the Oliy Majlis of the Republic of Uzbekistan, decrees and orders of the President of the Republic of Uzbekistan, the Convention and recommendations of the International Telecommunication Union.

On 16th October 2012, PE-4475 edict of the President of the Republic of Uzbekistan "On the establishment of the State Committee for Communications, Information and Telecommunication Technologies of the Republic of Uzbekistan" was confirmed. Also the Decree of the President of the Republic of Uzbekistan "On approving organization of the State Committee for Communications, Information and Telecommunication Technologies” PD-1836 on 23th October 2012, as well as in order to further improve public administration in the field of communication was approved. Information and telecommunication technologies on 19 December 2012, number 355, the Cabinet of Ministers of the Republic Uzbekistan approved the regulation. According to the Inspection:

  • control over the state of infrastructure development and effective use of information and communication technologies in state and economic administration bodies, local state authorities in accordance with the targeted directions and established norms;
  • to take measures within the scope of its authority to protect the quality of services provided by businesses in the field of distribution of postal and telecommunications, periodicals, as well as consumer rights;
  • control over the implementation of state and industry standards, applicable norms and rules in the design and construction of radio electronic devices and high-frequency devices and their use;
  • Reviewing applications and complaints of legal entities and individuals in accordance with applicable law and verifying the correct application of tariffs for postal and telecommunications services regulated by government agencies.

Further, in order to accelerate the development of the industry, improve control mechanisms, ensure quality communication and e-government services, the Decree of the President of the Republic of Uzbekistan "On measures to improve further the information technology and communications" PF-5349 was approved on 19th February 2018. In addition, on this same date, the Resolution of the President of the Republic of Uzbekistan "On the organization of the Ministry of Information Technologies and Communications of the Republic of Uzbekistan" PD-3549 was approved.

In order to ensure the implementation of this Decree and Resolution of the President of the Republic of Uzbekistan Cabinet of Ministers of the Republic of Uzbekistan “Ministry of Information Technologies and Communications of the Republic of Uzbekistan and about approval of Regulations on inspection on control in the field of communication, information and telecommunication technologies under the Ministry of Information technologies and communications development of the Republic of Uzbekistan" based on appendix 2 to Resolution No. 318 of May 1, 2018 approved a new regulation on the Inspectorate for Supervision in the Field of Communications, Information and Telecommunication Technologies.

The decision also gave the Communications Inspectorate the authority to distribute phonograms, audiovisual works and control the copyright of software products.

On November 21, 2018, the Resolution of the President of the Republic of Uzbekistan No. PD-4024 "On measures to control the introduction of information technology and communications, to improve the system of their protection" was adopted.

Based on resolution:

  • implementation of state control over compliance with the requirements of legislation, regulations and state standards in the field of communication, information and telecommunication technologies, distribution of periodicals;
  • to exercise state control over the quality of postal services, information technology and telecommunications services, the provision of consumer protection measures in the distribution of periodicals, phonograms, audiovisual works and computer programs within its competence;
  • state control over the observance of copyright laws and regulations in the distribution (sale, rental and public access) of phonograms, audiovisual works, computer programs;
  • implementation of state control over the development of infrastructure and effective use of information and communication technologies in the system of "e-government" in government agencies and organizations, as well as other organizations and departments in accordance with the requirements of regulatory legal acts;
  • automation of work and management processes, introduction and use of integrated information systems, interdepartmental networks of data transmission and exchange, integration of state information resources, including the effectiveness of e-government services;
  • on the basis of the principle of" last mile", the implementation of state control over the development of telecommunications infrastructure by expanding the distribution of broadband internet, multiservice communication technologies, the mobile market, other modern telecommunications services, as well as postal communication and printed publications were defined as the main tasks of the state policy.

On September 14, 2019, Resolution No. PP-4452 "On additional measures to improve the system of control over the introduction of information technologies and communications, their protection" was adopted. According to the resolution, the State Inspectorate "Uzkomnazorat" on the recommendation of the Agency for Information and Mass Communications is obliged to respond appropriately against entities violating the legislation of the Republic of Uzbekistan and report to the Cabinet of Ministers of the Republic of Uzbekistan.
